Terms and Conditions

For all website development and design services rendered to the Client by Wireattire Technologies, the following terms and conditions shall apply.

ACCEPTANCE

Any Client may accept these terms and conditions without having to sign an acceptance for them to be in effect. If a client accepts a quote, such client is understood to have understood the terms that apply and to have fully accepted these terms and conditions.

Please carefully read these terms and conditions. You have read and agreed to our terms and conditions if you make a purchase or use our services.

CHARGES

The project quotation that the client receives by email and/or in writing specifies the fees for the services that Wireattire Technologies will be providing. When the stipulated days have passed, Wireattire Technologies reserves the right to change or refuse to offer a quotation

Cash, checks, or bank transfers are accepted forms of payment for services. Invoices will include bank information.

CLIENT REVIEW

Throughout the design phase and once the overall website development is finished, Wireattire Technologies will give the client the chance to assess the website's appearance and content. Unless the client tells Wireattire Technologies to the contrary within stipulated days of the date the materials are made available to the client, such materials will be taken to have been accepted and approved at the conclusion of the project.

CONTENT CONTROL AND TURNAROUND TIME

Unless a specific delay is specifically requested by the Client and approved by Wireattire Technologies, they will install and publicly post or supply the Client's website by the date specified in the project proposal, or at date agreed with Client upon Wireattire Technologies receiving initial payment.

In exchange, the Client consents to designate a single person as a principal contact to help Wireattire Technologies move the commission along satisfactorily and quickly.

In order to complete the project, Wireattire Technologies will need the client to supply website material, such as text, photographs, videos, and sound files, among other things.

FAILURE TO PROVIDE REQUIRED WEBSITE CONTENT

As a small firm, Wireattire Technologies must make sure that the job we have scheduled is completed at the appointed time in order to remain productive. To make sure that your work is finished at the time scheduled, there are times when we may have to turn down offers for additional work and inquiries.

We reserve the right to close the project and demand immediate payment of the outstanding balance if you agree to give us the necessary information but fail to do so before the predetermined deadline. Simply put, the condition above instructs us to wait until you are ready to begin before giving the go-ahead.

Any website that Wireattire Technologies commissions and hosts will receive regular updates, according to the company. A fair use clause applies to this. If such demands require more than three hours of development time per site each year, Wireattire Technologies reserves the right to decline to update websites.

NOTE: Text content should be sent as an email attachment, a PDF/JPEG file, a Microsoft Word, Google Docs, Apple Pages, or other comparable document, with the pages in the supplied document representing the content of the relevant pages on your website. The titles of these pages must match those of the predetermined website pages. If you have any questions, please get in touch with us.

PAYMENT

After the live website is finished, Wireattire Technologies will issue invoices. The usual method of sending invoices is email, but the client has the option of receiving paper copies as well. Within thirty (30) days of receipt, invoices are due. Accounts that are overdue thirty (30) days after the invoice's due date will incur a service charge equal to the greater of twenty percent (20%) per month of the outstanding balance.

ADDITIONAL EXPENSES

Client agrees to pay back Wireattire Technologies for any additional costs incurred during the course of the project. Examples include buying specialized typefaces, stock images, plugins, etc. Prior to making the subsequent necessary material purchases, this payment will be necessary.

WEB BROWSERS

Every effort is made by Wireattire Technologies to guarantee that websites are made to be accessed by the majority of visitors. Websites are made to be compatible with the most widely used browsers right now (e.g. Firefox, Microsoft Edge, Google Chrome, etc.). The customer acknowledges that Wireattire Technologies cannot guarantee proper functionality across all operating systems and browsers.

Web pages that do not render properly in outdated or new browser versions that are released after the website has been built and delivered to the Client are not the responsibility of Wireattire Technologies. As a result, Wireattire Technologies retains the right to provide an estimate for any work required to modify the website's design or code in order to make it compatible with newer browser versions.

DEFAULT

Accounts shall be deemed in default if they are not paid within thirty (30) days of the invoice date. If the delinquent client continues to maintain any data or files on Wireattire Technologies's web space, Wireattire Technologies may decide to delete all of that content. Any data loss resulting from the termination of the service is not the responsibility of Wireattire Technologies. The removal of such content does not absolve the client of his or her financial responsibility to cover any unpaid fees charged to the client's account. Customers who have past-due accounts consent to cover Wireattire Technologies's reasonable costs, such as attorney fees and costs associated with collection efforts by third parties, incurred by Wireattire Technologies in upholding these Terms and Conditions.

TERMINATION

The client must request the termination of services in writing or by email, and it will take effect once it is received. Service termination requests made over the phone will not be honored before receiving written or email confirmation. For design work finished up until the date of the first notification of cancellation, the client will receive an invoice that must be paid in full within thirty (30) days.

INDEMNITY

Only legitimate reasons may be used with any Wireattire Technologies services. You consent to defend Wireattire Technologies and hold us free from any claims that your use of our service has injured you or another person.

COPYRIGHT

The Client authorizes Wireattire Technologies the right to publish and utilize any data, files, or graphic logos that the Client provides, while still holding the copyright to those materials. Any data or files that are protected by a third party's copyright must be used with the client's consent and within the bounds of those rights. The Client additionally agrees to release and hold harmless Wireattire Technologies from any claims stemming from the Client's carelessness or inability to obtain valid copyright licenses. The Client is further responsible for obtaining Wireattire Technologies authorization and rights for use of the same. The Client's assurance to Wireattire Technologies that all necessary licenses and authorities have been obtained shall be deemed to be a condition of any contract for website design and/or deployment. It may be necessary to provide proof of authorizations and powers.

ACCESS REQUIREMENTS

Wireattire Technologies must be given temporary read/write access to the client's storage directories, which must be reachable through FTP, if the client's website is to be put on a third-party server. Other resources might also need to be set up on the server, depending on the particulars of the project.

POST-PLACEMENT ALTERATIONS

Once deployed, Wireattire Technologies disclaims all liability for any adjustments made to the Client's pages by a third party. These changes can be additions, adjustments, or removals, among other things.

DOMAIN NAMES

On behalf of the client, Wireattire Technologies may make domain name purchases. Unless otherwise noted, Wireattire Technologies is responsible for the payment and renewal of those domain names. Wireattire Technologies disclaims all liability for any domain loss, cancellation, or other consequences brought on by the client's late or missed payments. To make sure that money is received on time, the client should maintain track of the payment deadlines.

GENERAL

Any prior statements, understandings, and agreements are superseded by these Terms & Conditions. The client agrees to and accepts these Terms and Conditions by sending an email, sending a text message, or paying a deposit.

GOVERNING LAW

The laws of India shall govern this Agreement.

LIABILITY

Wireattire Technologies expressly disclaims any responsibility for any of the following:

• any loss or damage brought on by an error;
• loss or harm brought on by omission;
• loss or harm brought on by a delay or error, whether brought on by carelessness or another factor during the creation of the website;
• loss or damage to client-supplied images for the website. It doesn't matter if the loss or damage is the result of negligence or something else.
• Wireattire Technologies's total liability to the Client for any claim or violation of this Agreement, whether or not due to negligence, shall be limited to the fees paid for the Services under this Agreement in relation to which the violation has occurred.

SEVERABILITY

The remaining provisions of this Agreement shall not be affected, and the Agreement shall not be void for the sole reason that one or more of its sections are determined to be invalid, unlawful, or unenforceable. Such invalid, unlawful, or unenforceable provision shall be replaced by a valid, legal, and enforceable provision that is mutually acceptable and that most closely matches the parties original meaning.
